They are classed under on-site sewage disposal (“septic”) systems (which) are governed by Title 5 of the State Environmental Code 310 CMR 15.000. And
“Title 5 requires that systems be inspected under certain circumstances. In this manner, system owners can be educated about the importance of properly maintaining their systems, and those systems that are an environmental or public health threat can be identified and upgraded.”

Therefore as long as you maintain your cesspool so it does not become a environmental or public concern your cesspool can continue to process a property’s waste and wont need to be upgraded. However a cesspool does generally require more ongoing maintenance than a conventional septic system.
